Absconding in UAE is one of the most feared phrases in employment, and one of the most misunderstood. An absconding report can cancel your work permit and stop you from taking a new job for a year. Yet the rules behind it are narrower than most people think, and a worker can contest a report that has no basis.
This guide explains what absconding means under current UAE law, when an employer can file a report, what happens next, how to check your position, and how to contest or cancel a report through MoHRE. It covers private-sector employees on the mainland.
Absconding in UAE: the quick answer
| Question | Short answer |
|---|---|
| What is absconding? | Leaving work without a lawful reason and without contact. MoHRE now calls it a work abandonment or “absence from work” complaint. |
| When can an employer report it? | After more than 7 consecutive days of absence, when it cannot reach you and does not know where you are |
| Main consequence | MoHRE cancels your work permit, and a proven report brings a one-year ban on a new work permit |
| When does the ban start? | u.ae says the ban period starts when the worker leaves the UAE |
| Who is exempt from the ban? | Some categories, such as Golden Visa holders and workers on family sponsorship |
| Can you remove a report? | Yes. The employer or the employee can apply to MoHRE to cancel it. |
What absconding means in UAE today
People use “absconding” for any worker who walks away from a job. The law is more precise. Under Ministerial Resolution No. 47 of 2022, an employer may register an “unexpected work abandonment” complaint against a worker who:
- stays away from work without a lawful reason for more than 7 consecutive days, and
- does not answer the employer, who does not know where the worker is.
Both conditions matter. An employee who misses work but answers calls and emails is not, by this definition, absconding. MoHRE’s own service names use “absence from work”, and you will still see “absconding report” in brackets.
Absence and absconding are not the same thing
Article 44 of Federal Decree-Law No. 33 of 2021 lets an employer dismiss a worker without notice for absence without a legitimate reason of more than 20 non-consecutive days, or more than 7 consecutive days. That is a dismissal ground. An absconding report is a separate MoHRE complaint, with the extra condition that the employer cannot contact the worker. The two can overlap, but they lead to different processes.
If your employer dismisses you for absence, our termination of employment guide explains what you are still entitled to.
How an employer files an absconding report
Mainland employers use MoHRE’s “Filing a Labour Complaint – Absence From Work” service. According to MoHRE, the service has these conditions:
- The absence has lasted more than 7 days.
- The employee is inside the UAE.
- The employer has paid any fines on the work permit.
- The employer attaches the employee’s entry and exit report from ICP, issued within the last 30 days.
Once MoHRE approves the complaint, it cancels the work permit automatically. MoHRE says it reviews each case to check that the complaint is valid before it imposes a ban.
Domestic workers fall under a separate MoHRE service and a separate law, and their rules differ. This guide does not cover them.
What happens if MoHRE approves an absconding report
Your work permit ends
Approval cancels your work permit. Your residence visa depends on that permit, so you need to plan your next step quickly. Our employment visa cancellation guide explains grace periods and how to check your residence status.
A one-year ban on a new work permit
Article 50 of the Labour Law says that a foreign worker who leaves work without a legitimate reason before the contract ends cannot receive another work permit for one year. The law also bars any employer who knows about it from hiring that worker during the ban.
The official texts describe the start date differently. The Decree-Law counts the year from the date of absence. Ministerial Resolution No. 47 of 2022 and u.ae say it runs from the worker’s departure, and u.ae states plainly that “the ban period starts once the worker departs from the UAE”. MoHRE lifts the ban automatically once the period ends.
Who is exempt from the ban
The law lets MoHRE exempt some categories from the one-year ban. Cabinet Resolution No. 1 of 2022 names groups such as workers sponsored by a parent or family member, workers rejoining the same employer, people with skill levels the market needs, and Golden Visa holders. Ask MoHRE whether your situation qualifies before you assume it does.
What you should not believe
Social media posts often claim that absconding means automatic jail, a lifetime ban or deportation. We found no official MoHRE, ICP or u.ae source that supports those claims for private-sector workers. The official consequence is the permit cancellation and the one-year work permit ban. Overstay fines can still follow if your residence visa lapses and you stay on.
How to check if you have an absconding report
MoHRE does not offer a separate public “absconding status” page. Use these official routes instead:
- Check your work permit. If MoHRE has cancelled your permit unexpectedly, that is a warning sign. Our guide to checking your labour contract and work permit shows how to check it, including the labour ban check.
- Call MoHRE on 600590000 with your Emirates ID or passport details and ask whether a complaint exists against you.
- Check your residence status on ICP Smart Services or with GDRFA Dubai.
Many agents and websites offer “absconding checks” or “absconding removal” for a fee. Only MoHRE can confirm or cancel a report. Never pay a third party who promises to remove one, and never share your passport or Emirates ID details with an unofficial site.
How to contest or remove an absconding report
MoHRE runs a service called “Cancellation of an Absence from Work Complaint (Absconding Report)”. Either the employer or the employee can apply, through the MoHRE website or app using UAE Pass. MoHRE says it takes about 14 working days and sends the result by text message.
Article 7 of Ministerial Resolution No. 47 of 2022 lists the situations in which MoHRE can cancel a report:
- fewer than 7 consecutive days had passed since your last working day
- you were at work, or on leave the law allows
- your employer agrees to restore the working relationship and pays any fines due
- you and your employer had agreed that you would stop working
- you had a legitimate reason for not reporting to work
If MoHRE has already imposed a ban, u.ae says you can contest it by submitting a grievance through MoHRE’s channels, with documents that show the ban is unjustified.
Evidence that helps your case
- Emails, messages or call logs that show you stayed in contact with your employer
- Approved leave requests, medical certificates or sick leave approvals
- Your resignation letter and proof that your employer received it
- Payslips or bank statements that show unpaid salary, if you stopped work because your employer breached the contract
- Any labour complaint you filed with MoHRE, with its reference number
How to leave a job without an absconding report
Most absconding disputes start when communication stops. Protect yourself by leaving properly:
- Resign in writing and keep proof of delivery. Our resignation and notice period guide explains the rules.
- Serve your notice period unless your employer agrees in writing to release you earlier.
- Stay reachable by phone and email until the cancellation is complete.
- File a MoHRE complaint first if your employer stops paying you or breaks the contract. Do not simply stop going to work.
- Leaving during probation? Follow the notice rules in our probation period guide, because a resignation during probation can also trigger a one-year permit ban in some cases.
An absconding complaint also blocks an unemployment insurance claim. Our ILOE insurance guide explains who can claim.
Absconding in UAE: frequently asked questions
What is absconding in UAE?
It means leaving work without a lawful reason for more than 7 consecutive days while the employer cannot reach you. MoHRE treats it as a work abandonment or “absence from work” complaint.
How long is the ban after absconding?
One year without a new work permit, under Article 50 of the Labour Law. u.ae says the period starts when the worker leaves the UAE, and MoHRE lifts it automatically when it ends.
Can my employer file an absconding report if I resigned?
The report requires an unexplained absence and no contact. If you resigned in writing and stayed reachable, keep that proof. MoHRE can cancel a report when the worker and employer had agreed the work would end.
How do I remove an absconding case?
Apply through MoHRE’s “Cancellation of an Absence from Work Complaint” service with UAE Pass, and attach your evidence. If a ban already applies, submit a grievance to MoHRE.
Can I get a new job after absconding?
Not with a new work permit during the one-year ban, unless you fall into an exempt category or MoHRE cancels the report. Once the ban ends, you can apply normally.
Protect your record
An absconding report is serious, but it is not a mystery. It needs more than 7 days of unexplained absence with no contact, and MoHRE can cancel it when the facts do not support it. Keep your communication in writing, use MoHRE instead of walking away, and check your status on official channels only.
