Probation is the stage of a UAE job where people most often assume the rules are loose. They are not. Since February 2022, Federal Decree-Law No. 33 of 2021 has governed the probation period in UAE employment tightly, and both sides now carry obligations that did not exist under the old law.
Get this wrong and it costs real money. Walk out without notice and you can owe your employer a month’s wages. Accept a nine-month probation clause and you may be surrendering rights you already hold. This guide sets out how long probation can last, exactly what notice applies in each situation, what happens to your leave, and what protections stay with you from day one.
How long can a probation period be in the UAE?
Six months is the ceiling. According to the official UAE government portal, an employee’s probation period must not exceed six months, and no employer may extend it for another term.
Three consequences follow from that single rule:
- A longer clause does not bind you. If your contract states nine or twelve months of probation, the portion beyond six months conflicts with the law.
- Probation never restarts. An employer cannot reset the clock or impose a second probation for the same job.
- Confirmation happens by default. Where the employee completes probation and continues in service, that probation period counts as part of their total service.
That last point matters more than most candidates realise. Your probation months are not a write-off. They count toward your length of service, which feeds directly into your end-of-service entitlement later.
One practical check before you sign anything: the probation length that governs you is the one your MoHRE employment contract states, not whatever figure someone mentioned during interviews.
Notice rules during probation, and why nobody leaves on the spot
This is where the 2022 law changed things most sharply. Previously an employer could end probation immediately. Now every scenario demands written notice, and the length depends on who is ending the contract and what the employee plans to do next.

Note the asymmetry. An employee moving to another UAE employer owes a full month, while an employee leaving the country owes only fourteen days. The reason is straightforward: the law treats a worker who stays in the same labour market differently from one who exits it.
Also worth understanding is what notice does not require. An employer terminating during probation does not have to prove a performance failure. The notice itself, however, is mandatory. Simply stopping attendance is the costliest version of resigning, because it exposes you to a claim for the notice period you failed to serve.
If your probation is ending in a few days, that does not remove the obligation either. The notice requirement applies throughout probation, right up to the final day.
The three-month return rule most candidates have never heard of
Here is a provision that surprises almost everybody, and it can affect whether a new employer wants to hire you.
Where an employee resigns during probation to leave the UAE, then returns within three months of departure on a new work permit, the new employer becomes liable to compensate the previous employer for that employee’s recruitment costs, unless the current employer and the employee agreed otherwise.
Practically speaking, this creates a cost for your next employer that has nothing to do with your ability. Therefore, if you left the UAE during probation and are applying again within that window, raise it early in the conversation rather than letting it surface after an offer. Recruiters handle it far better when they know upfront.
Sick leave during probation is the biggest gap in your protection
Probation does not suspend your rights generally, but it does carve out one significant exception, and employees discover it at the worst possible moment.
Article 31(2) of the labour law gives a worker no right to paid sick leave during the probation period. An employer may still grant unpaid sick leave if a medical report from the relevant medical authority confirms that the leave is necessary. Many employers choose to pay anyway, but that reflects company policy rather than a legal floor.
Once you pass probation, the position changes considerably:

In either case, report illness to your employer within three working days and supply a medical report from a licensed medical entity. Late notification can cost you the entitlement regardless of how genuine the illness was.
Annual leave while you are on probation
Annual leave works differently from sick leave, and the outcome is more favourable.
The Ministry of Human Resources and Emiratisation confirms in its worker guidance that an employer may grant leave from your annual leave balance during probation. More importantly, if you do not pass probation, you keep the right to claim compensation for the annual leave balance you accrued.
Timing, however, sits with the employer. Your employer may specify when you take that leave, according to work requirements, so approval during probation stays discretionary rather than automatic.
What probation does not change
Beyond the sick leave exception, probation is a trial of fit rather than a discount on your entitlements. From your first day these still apply:

What to check before you accept the offer
Most probation disputes trace back to a contract nobody read carefully. Before signing, confirm these four points in writing:
- The probation length the contract states, and that it matches the MoHRE contract rather than only the offer letter.
- The notice clause covering probation, since some contracts restate the statutory periods and some add conditions.
- Who bears visa and recruitment costs if you resign during probation, because contracts vary on this point.
- Whether company policy pays sick leave during probation, given the law does not require it.
